Purpose

We process your personal data on our Website for the following purposes:

  • Client management on our Website
  • Litigation management

Below, you can find for each purpose the personal data that we process, why we process it, how we obtain the data, how long we retain the data and with whom we share it.

1) Client management on our Website

In the context of client management on our Website, we may process your electronic identification data (IP address and cookies). Furthermore, we process your personal identification data (name, (company) name, (company) address, telephone number and e-mail address), VAT-number, financial information, your signature and other information you may provide to us.

These personal data allow us to set-up and operate your profile on our Website that facilitates and supports the sale of vehicles. Furthermore, these personal data allow us to send you relevant updates via e-mail and/or sms on the status of your orders (current orders, unsigned orders, scheduled transports, sent documents, outstanding payments etc.) which you can also review at any time on our Website. These personal data also allow us to conclude online orders by digital signature.

The legal basis for the processing of your personal data is first the entering into and/or execution of an agreement to which you are (or may become) a party (art. 6, §1, (b) GDPR). If you are a B2B customer we have a legitimate interest to process your personal data to enter into and perform the contract (art. 6, §1, (f) GDPR). The legal basis for placing technically essential and functional cookies is a legitimate interest to offer a well-functioning and user-friendly My Quadriga Platform (Art. 6, §1, (f) GDPR).

We obtain this personal data directly from you (i.e. when using our Website or when placing an order on our Website).

For purposes of our client management on our Website, we may store your personal data up to 10 years after your last active session on our Website. With regard to the personal data gathered through cookies, the expiration date varies per cookie. You can change your cookie preferences at any time.

We share your personal data with third parties with whom we work together for our Website (IT and software providers). Furthermore, we may share this personal data with affiliated partners (wholesalers, distributors/dealers) on a need-to-know basis.

2) Litigation management

For our litigation management, we process your personal identification data (name, (company) address, e-mail address), employment data (if you are a B2B customer) and any other information relevant to the (potential) litigation.

This data allows us to defend our legitimate interests in all forms of dispute resolution and the administration of disputes. The legal basis for this processing is the legitimate interest to exercise our rights of defense (art. 6, §1, (f) GDPR). We always obtain this personal data directly from you. For our litigation management, we store your personal data for up to 5 years after we have concluded the dispute or – in case of legal proceedings – 5 years after the expiry of any legal recourse.

We only share this personal data with third parties with whom we work together for the above-mentioned purposes (external legal advisors, debt collection agencies) and other third parties on a need-to-know basis (public authorities, judicial authorities, bailiffs).

Security

We have implemented appropriate technical and organizational measures to ensure the confidentiality of your personal data and to protect your data from accidental and unlawful destruction, loss, alteration, unauthorized disclosure and access.

We have made the necessary contractual arrangements with the third parties with whom we work together and will not transfer your personal data outside the European Economic Area without ensuring that your data is granted an equivalent level of protection there.
